Terms of Service

1. Agreement to Terms

By accessing or using the PageUp reading incentivization platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including schools, teachers, administrators, students, and parents.

2. Description of Service

PageUp provides a web-based reading incentivization platform designed for elementary schools. The Service includes:

  • Access to a library of reading comprehension quizzes
  • Student progress tracking and reporting
  • Gamification features including points, badges, and leaderboards
  • Teacher and administrator dashboards
  • Classroom and school-wide reading competitions

3. Eligibility and Account Registration

3.1 School Accounts: The Service is provided to schools and educational institutions. Schools must register for an account and provide accurate, complete information.

3.2 Teacher and Administrator Accounts: Teachers and administrators must be authorized by their school to create accounts and access the Service.

3.3 Student Accounts: Student accounts are created and managed by schools through authorized personnel. Students under 13 years of age may only use the Service with parental consent obtained through their school.

3.4 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use the Service only for lawful educational purposes. You agree NOT to:

  • Share quiz questions or answers outside the platform
  • Attempt to manipulate points, scores, or leaderboard standings
  • Access or attempt to access accounts belonging to other users
  • Upload malicious code or attempt to compromise system security
  • Use the Service in any manner that violates applicable laws or regulations
  • Harass, bully, or harm other users of the Service
  • Collect or store personal information about other users without authorization
  • Reverse engineer or attempt to extract source code from the Service

5. Subscription and Payment

5.1 Pricing: PageUp offers subscription plans on a per-school or per-student basis. Current pricing is available at pageupreading.com.

5.2 Payment Terms: Subscription fees are billed annually in advance. Payment is due upon receipt of invoice.

5.3 Refunds: Refunds may be provided at our discretion on a case-by-case basis. Contact us at matt@pageupreading.com to discuss refund requests.

5.4 Renewal: Subscriptions automatically renew annually unless cancelled at least 30 days before the renewal date.

6. Intellectual Property

6.1 PageUp Content: All content provided by PageUp, including quiz questions, software, graphics, and text, is owned by PageUp and protected by copyright and other intellectual property laws.

6.2 User Content: Schools retain ownership of student data and information uploaded to the Service. By using the Service, schools grant PageUp a limited license to use this data solely to provide the Service.

6.3 Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit written permission.

7. Privacy and Data Protection

Our collection, use, and protection of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our data practices as described in the Privacy Policy.

8. Service Modifications and Availability

8.1 Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to schools.

8.2 Availability: While we strive for 99.9% uptime, we do not guarantee that the Service will be available at all times. We are not liable for any interruption of service.

9. Termination

9.1 By School: Schools may terminate their subscription at any time by providing written notice. Termination will be effective at the end of the current billing period.

9.2 By PageUp: We may terminate or suspend access to the Service immediately if you violate these Terms, fail to pay fees, or for any other reason with 30 days notice.

9.3 Effect of Termination: Upon termination, your right to use the Service will immediately cease. Schools may request export or deletion of student data within 30 days of termination.

10. Disclaimers and Limitations of Liability

10.1 As-Is Service: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10.2 Educational Results: We do not guarantee specific educational outcomes from use of the Service. Reading improvement depends on many factors beyond our control.

10.3 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGEUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless PageUp from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Dispute Resolution

12.1 Governing Law: These Terms are governed by the laws of the United States and the state in which PageUp is registered, without regard to conflict of law provisions.

12.2 Dispute Resolution: Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in the courts of competent jurisdiction.

13. General Provisions

13.1 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PageUp regarding the Service.

13.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

13.3 Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment: You may not assign these Terms without our written consent. We may assign these Terms without restriction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify schools of material changes by email and by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
